1. Acceptance of Terms

By accessing or using MealBake (“the Service”), you agree to be bound by these Terms of Service. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY — INCLUDING ALL DISCLAIMERS OF LIABILITY AND ASSUMPTIONS OF RISK — YOU MUST STOP USING MEALBAKE IMMEDIATELY AND LEAVE THE WEBSITE.

MealBake reserves the right to update these terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

1a. Assumption of Risk Notice

IMPORTANT: MEALBAKE GENERATES CONTENT USING ARTIFICIAL INTELLIGENCE. THIS CONTENT MAY BE INACCURATE, INCOMPLETE, OR UNSAFE. BY USING THIS SERVICE YOU ACCEPT FULL AND SOLE RESPONSIBILITY FOR ANY CONSEQUENCES — FORESEEABLE OR UNFORESEEABLE — ARISING FROM YOUR USE OF THE SERVICE OR ANY CONTENT GENERATED THROUGH IT. MEALBAKE BEARS NO RESPONSIBILITY WHATSOEVER FOR ANY HARM OF ANY KIND RESULTING FROM USE OF THIS PLATFORM.

1b. Notice to European Union Users

If you are located in the European Union, European Economic Area, or United Kingdom, please read this section carefully in addition to the rest of these Terms.

Certain consumer protection laws in EU member states may provide you with rights that cannot be waived by contract. Nothing in these Terms is intended to limit rights that cannot lawfully be excluded under applicable EU law. However, to the maximum extent permitted by applicable EU law:

MealBake expressly excludes all implied warranties and conditions regarding the accuracy, safety, or fitness of AI-generated content
MealBake's total aggregate liability to you shall not exceed the total amount you have paid to MealBake in the twelve (12) months preceding the claim
MealBake is not a food safety authority, medical provider, or nutritional advisor. No content on this platform should be treated as professional food safety, medical, or nutritional advice
You voluntarily and knowingly assume all risks associated with using AI-generated recipe content, including risks that may not be foreseeable at the time of use

EU users acknowledge that MealBake is an automated content generation tool, not a professional service provider, and that all responsibility for verifying and safely using generated content rests solely with the user.

2. Description of Service

MealBake is a multi-faceted platform that operates in three capacities:

AI Recipe Generator — users generate AI-powered recipes using the Service and publish them to their personal blogs
Blogging Platform — users publish and manage their own recipe blogs at username.mealbake.com
Content Platform — MealBake independently publishes its own recipe content at mealbake.com, which may be AI-generated, human-created, or a combination of both

Specific features of the Service include:

AI-powered recipe generation — full recipes including ingredients, steps, nutritional context, and cooking metadata, generated via OpenAI API based on your input
AI food photography — illustrative dish images generated via third-party AI image models (Replicate). These are not photographs and do not represent actual food
Human-created recipes — the Service may also contain recipes written or contributed by human authors, editors, or creators. These are clearly distinguished from AI-generated content where possible
User image uploads — ability to upload your own photos to accompany recipes, subject to automated content moderation via AWS Rekognition
Personal blog subdomain — a publicly accessible blog at username.mealbake.com with customizable themes and layouts
Multilingual publishing — AI-assisted translation of recipe content into supported languages
SEO features — structured data (JSON-LD), canonical tags, and metadata to assist with search engine indexing

The Service operates on a credit-based system where users purchase credits to generate content. Credit costs vary by generation type as described in Section 4.

3. Account Registration

To use MealBake you must:

Create an account using a valid email address or via Google/Facebook OAuth
Provide accurate and complete information
Be at least 13 years of age
Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. You agree to notify MealBake immediately of any unauthorized use of your account at [email protected]. MealBake is not liable for any loss resulting from unauthorized use of your account due to your failure to maintain account security.

3a. Account Security

You are solely responsible for maintaining the confidentiality of your password and account details. You agree to: (a) immediately notify MealBake of any unauthorized use of your account or any breach of security; and (b) ensure that you log out from your account at the end of each session. MealBake will not be liable for any loss or damage arising from your failure to comply with this section.

3b. Modifications to Service

MealBake reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any part thereof, with or without notice. You agree that MealBake will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. MealBake also reserves the right to establish general practices and limits concerning use of the Service, including maximum storage space, and to terminate accounts that are inactive for an extended period of time.

4. Credits and Payments

MealBake operates on a pay-per-use credit system:

Credits are purchased in packages and are non-refundable unless required by applicable law
Credits do not expire
New accounts receive 300 free credits upon registration — one free credit grant per person
Credits have no cash value and cannot be redeemed, transferred, or exchanged for money under any circumstances
Credits are non-transferable between accounts
Creating multiple accounts to obtain additional free credits is strictly prohibited and will result in immediate account termination and forfeiture of all credits
MealBake reserves the right to modify credit pricing at any time with reasonable notice
If MealBake discontinues the Service, purchased (non-free) credits may be refunded on a pro-rata basis at MealBake's sole discretion

All payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service available at stripe.com/legal. MealBake does not store your payment card information. Payments are final and non-refundable except where required by applicable law.

5. User Content and Generated Output

INPUT CONTENT: You retain ownership of any recipe ideas, concepts, or information you submit to MealBake as input (“Submissions”). By using the Service, you grant MealBake a limited, non-exclusive, worldwide license to process your Submissions solely for the purpose of generating and publishing your recipes.

AI-GENERATED OUTPUT: Recipes, text, and other content generated by the AI based on your Submissions (“Output”) are provided to you for your use. Due to the nature of machine learning, Output may not be unique — other users may receive the same or similar content from similar inputs. MealBake makes no representation that copyright will vest in any Output. You are solely responsible for verifying any Output before publishing or relying on it.

You agree that MealBake may use anonymized, aggregated data about how the Service is used (including types of recipes generated) to improve the Service and its underlying AI models. MealBake will not use your personally identifiable information or specific recipe content to train AI models without your explicit consent.

USER IMAGE UPLOADS: If you upload your own photos to the Service, you represent and warrant that:

You own all rights to the uploaded image or have obtained all necessary permissions and licenses
The image does not infringe any third-party copyright, trademark, privacy, or publicity rights
The image does not contain illegal, obscene, or harmful content
You grant MealBake a license to host, display, and serve the image on your blog

You are solely responsible for ensuring that uploaded images comply with all applicable laws and third-party rights. MealBake is not responsible for any copyright infringement or other claims arising from your uploaded images. All uploaded images are subject to automated content moderation as described in Section 5a.

You are responsible for ensuring that any content you submit or generate does not violate third-party intellectual property rights, applicable laws, or these Terms.

5a. Content Moderation

MealBake uses automated content moderation tools including AWS Rekognition to scan user-uploaded images for prohibited content such as nudity, graphic violence, or illegal material. By uploading images to the Service, you expressly consent to this automated scanning.

MealBake reserves the right to remove any content — including uploaded images, generated recipes, or blog posts — that violates these Terms or is deemed inappropriate at MealBake's sole discretion, without prior notice. MealBake is not obligated to provide a reason for content removal or to maintain a review or appeal process.

Automated moderation is not perfect. MealBake is not liable for any incorrectly removed content or for any prohibited content that is not detected by automated systems.

6. AI-Generated Content and User Responsibility

MealBake uses artificial intelligence (OpenAI API) to generate recipe content on your behalf. BY USING THIS SERVICE, YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT:

All AI-generated content — including recipes, instructions, ingredient quantities, cooking times, temperatures, and nutritional information — may contain errors, inaccuracies, or omissions
MealBake does NOT guarantee the accuracy, completeness, safety, or fitness for any purpose of any AI-generated content
You are solely responsible for reviewing, verifying, and validating all generated content before using, publishing, or sharing it
You are solely responsible for any harm, injury, illness, allergic reaction, property damage, or any other adverse outcome resulting from following, using, or relying on any content generated or published through MealBake
MealBake bears NO responsibility whatsoever for how you or any third party uses, interprets, or acts upon any content generated or displayed on this platform
AI-generated content is provided strictly “as is” without warranty of any kind, express or implied

YOU USE ALL AI-GENERATED CONTENT AT YOUR OWN RISK. IF YOU DO NOT ACCEPT FULL RESPONSIBILITY FOR THE USE OF GENERATED CONTENT, YOU MUST STOP USING MEALBAKE IMMEDIATELY.

6a. Not Professional Advice

NOTHING ON MEALBAKE CONSTITUTES PROFESSIONAL FOOD SAFETY, MEDICAL, NUTRITIONAL, DIETARY, OR ALLERGEN ADVICE. All content generated through MealBake is for informational and entertainment purposes only.

You should always:

Consult a qualified medical professional or registered dietitian before making dietary changes, especially if you have health conditions, food allergies, or intolerances
Verify cooking temperatures and times using official food safety guidelines from your country's food safety authority
Check all ingredients for allergens before serving food to others
Never serve AI-generated recipes to others without independently verifying their safety

MEALBAKE IS NOT RESPONSIBLE FOR ANY ALLERGIC REACTIONS, FOOD POISONING, ILLNESS, INJURY, OR ANY OTHER HARM ARISING FROM THE PREPARATION OR CONSUMPTION OF FOOD BASED ON CONTENT GENERATED THROUGH THIS PLATFORM, WHETHER BY YOU OR ANY THIRD PARTY.

6b. User Assumption of All Risk

By continuing to use MealBake, you expressly assume all risks associated with:

Following AI-generated recipes and cooking instructions
Consuming food prepared according to AI-generated content
Publishing AI-generated content to your blog and any consequences arising from third parties reading or following that content
Any unpredictable, unintended, or harmful outcomes arising directly or indirectly from content generated on or accessed through MealBake
Any use of MealBake content in any context, whether personal, commercial, or otherwise
Third parties acting on content published through your MealBake blog

MealBake, its operators, employees, and affiliates shall bear NO liability for any direct, indirect, incidental, consequential, or any other form of harm — including but not limited to physical injury, illness, allergic reactions, financial loss, reputational damage, or any other adverse outcome — resulting from the use of this platform or its generated content, regardless of how such harm occurs.

6c. AI Image Generation Disclaimer

AI-generated food images produced through MealBake are created by third-party AI image generation models (Replicate). You acknowledge and agree that:

AI-generated images are illustrative representations only and are NOT photographs of actual food
AI images may not accurately represent portion sizes, colors, textures, or the actual appearance of a prepared dish
AI images may not reflect the nutritional content, allergens, or ingredients in the recipe
MealBake makes no warranty that AI-generated images are accurate, appealing, or suitable for any purpose
AI image generation is subject to Replicate's terms of service and acceptable use policies
AI images may resemble existing content — you bear sole responsibility for any claims arising from the use of AI-generated images

YOU MUST NOT represent AI-generated images as original photographs or as depictions of actual food you have prepared. Doing so may constitute consumer deception and is a violation of these Terms.

6d. Blogger Responsibility and Subdomain Policy

SUBDOMAIN LICENSE: Your blog at username.mealbake.com is provided as a REVOCABLE LICENSE, not a purchase or ownership of any domain or hosting. MealBake retains full ownership and control of the mealbake.com domain and all subdomains. MealBake may reclaim, suspend, redirect, or terminate any subdomain at any time, for any reason, without prior notice or compensation.

USERNAME RULES: Your chosen username/subdomain:

Must not infringe any trademark, brand name, or intellectual property of any third party
Must not impersonate any person, company, or organization
Must not be offensive, obscene, or misleading
Cannot be transferred to another user or sold
May be reclaimed by MealBake if your account is suspended or terminated

BLOGGER OBLIGATIONS: If you publish AI-generated recipes to a public blog through MealBake, you acknowledge that:

You are the publisher of record for all content on your blog
You are solely responsible for the accuracy, safety, and legality of content you publish
MealBake is a tool — it is not the publisher, editor, or distributor of your blog content
You are solely liable for any harm caused to any third party who reads or follows recipes published on your blog
You must include appropriate disclaimers on your own blog advising readers to verify recipes independently
You must not represent AI-generated recipes as having been created or verified by a licensed nutritionist, dietitian, chef, or any other professional
You must not represent AI-generated images as original food photography

BLOG AVAILABILITY: MealBake does not guarantee continuous availability of your blog subdomain. Maintenance, technical issues, or service disruptions may cause temporary or permanent unavailability. MealBake provides no uptime SLA and is not liable for any loss arising from blog downtime.

6e. Multilingual Content Disclaimer

MealBake provides AI-assisted translation of recipe content into multiple languages. You acknowledge that:

AI translations may contain errors, inaccuracies, or culturally inappropriate content
MealBake does not guarantee the accuracy or quality of any translated content
You are solely responsible for verifying the accuracy of translated content before publishing
Legal compliance in non-English speaking jurisdictions (including food labeling laws, consumer protection laws, and language requirements) is entirely your responsibility
MealBake is not liable for any harm arising from inaccurate translations

6f. SEO and Search Engine Disclaimer

MealBake generates structured data (JSON-LD), canonical tags, and other SEO metadata for your blog. You acknowledge that:

MealBake makes no guarantee of any search engine ranking, indexing, or traffic to your blog
Search engine policies regarding AI-generated content vary and may change at any time
Your blog content may be penalized, de-indexed, or filtered by search engines due to being AI-generated
MealBake is not responsible for any SEO outcome, loss of traffic, or search engine penalties
You are solely responsible for compliance with search engine guidelines and applicable content policies

7. Prohibited Uses

You agree not to use MealBake to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, hateful, or discriminatory
Violate any applicable local, state, national, or international laws or regulations
Attempt to gain unauthorized access to the Service or other users' accounts
Use automated tools to scrape, crawl, or extract data from the Service
Resell or redistribute the Service without prior written consent from MealBake
Generate spam, misleading content, or unsolicited commercial communications
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload or transmit viruses, malware, or any other malicious code
Interfere with or disrupt the Service or servers or networks connected to the Service
Solicit personal information from anyone under the age of 13
Use the Service or any Output to create, develop, or improve any competing products or services, or to train other artificial intelligence or machine learning models
Circumvent, remove, alter, or deactivate any content protection or geographic restriction on the Service
Engage in any data mining, scraping, or similar data gathering methods not authorized by MealBake
Use the Service in any manner that could damage, disable, or impair the Service

In no event will you use any Output generated through MealBake to compete with MealBake, including to create a competing product or service. MealBake reserves the right to investigate and take appropriate action against anyone who violates this provision, including terminating their account and reporting them to law enforcement authorities.

7a. MealBake as a Content Platform

In addition to being a user tool and blogging platform, MealBake independently operates as a recipe content platform at mealbake.com. In this capacity:

MealBake publishes its own recipe content which may be AI-generated, human-written, or a combination of both
MealBake content is published across multiple languages and locales
Content published directly by MealBake is owned by MealBake and protected by applicable intellectual property laws
You may not reproduce, scrape, copy, redistribute, or create derivative works from MealBake platform content without prior written permission
MealBake platform content is provided for personal, non-commercial use only unless otherwise stated

CONTENT SEPARATION: The MealBake main platform (mealbake.com) and user blogs (username.mealbake.com) are entirely separate and independent. Content published by a user on their personal blog subdomain is NOT republished, redistributed, or otherwise used on the main MealBake platform without the user's explicit consent. Conversely, content published on mealbake.com does not appear on user blogs. MealBake does not claim ownership of or editorial responsibility for content published on user blog subdomains.

The presence of AI-generated content on the platform does not constitute an endorsement, verification, or guarantee of such content by MealBake.

7b. Platform Content Disclaimer

ALL MEALBAKE PLATFORM CONTENT — whether AI-generated or human-created — IS PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. Specifically:

AI-generated recipes on the platform may contain errors, inaccuracies, or unsafe instructions
Human-created recipes are contributed in good faith but are not independently verified by MealBake for accuracy, safety, or nutritional content
MealBake does not employ licensed nutritionists, dietitians, chefs, or food safety professionals to review platform content
Nutritional information, if provided, is estimated and may be inaccurate
Cooking times, temperatures, and techniques may vary depending on equipment, altitude, ingredient quality, and other factors
Some recipes may contain allergens — always verify ingredients independently before preparing food for others
MealBake does not guarantee that any recipe is safe, suitable, or appropriate for any individual, dietary need, or health condition

MEALBAKE IS NOT RESPONSIBLE FOR ANY HARM, ILLNESS, INJURY, ALLERGIC REACTION, PROPERTY DAMAGE, FINANCIAL LOSS, OR ANY OTHER ADVERSE OUTCOME ARISING FROM THE USE OF ANY CONTENT PUBLISHED ON THE MEALBAKE PLATFORM, WHETHER AI-GENERATED OR HUMAN-CREATED. ALL PLATFORM CONTENT IS USED ENTIRELY AT YOUR OWN RISK.

7c. Human-Created Content and Contributors

The Service may include recipes and content created by human contributors, editors, or authors (“Contributor Content”). With respect to Contributor Content:

MealBake does not independently verify the accuracy, originality, completeness, or safety of Contributor Content
Contributors are solely responsible for ensuring their submissions are original, accurate, safe, and do not infringe any third-party rights
MealBake reserves the right to edit, modify, translate, publish, or remove any Contributor Content at its sole discretion without notice or compensation
By submitting content to MealBake as a contributor, you grant MealBake a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, translate, distribute, and publish your content across all MealBake platforms and locales
Contributors warrant that their submitted content is original, does not infringe any third-party intellectual property rights, and does not contain harmful, misleading, or illegal information
MealBake is not liable for any claims arising from Contributor Content including but not limited to intellectual property infringement, inaccurate instructions, food safety issues, or any harm suffered by readers

The MealBake platform, including its design, code, branding, and original content, is owned by MealBake and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written permission.

8. Intellectual Property

8a. Copyright / DMCA

MealBake respects the intellectual property of others. If you believe that content on MealBake infringes your copyright, please send a written notice to [email protected] with the subject line “DMCA Takedown Request” including:

A physical or electronic signature of the copyright owner or authorized representative
Identification of the copyrighted work claimed to be infringed
Identification of the infringing content and its location on the Service
Your contact information (address, telephone number, email)
A statement of good faith belief that the use is not authorized by the copyright owner
A statement, under penalty of perjury, that the information in the notice is accurate

MealBake will process valid DMCA notices and take appropriate action, including removing infringing content and terminating repeat infringers' accounts.

8b. Third-Party Services

The Service relies on and may display links to third-party services including OpenAI (recipe generation), Replicate (image generation), Stripe (payments), Google and Facebook (authentication), AWS (image moderation), and Cloudflare (infrastructure and analytics). MealBake has no control over and is not responsible for the accuracy, availability, reliability, or content of any third-party services. Your use of third-party services is at your own risk and subject to those third parties' own terms and conditions and privacy policies. MealBake will not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any third-party service. Disruption or changes to any third-party service may affect MealBake's functionality and MealBake is not liable for any resulting impact on your use of the Service.

9. Account Deletion, Data Loss, and Backups

If you delete your account or your account is terminated:

Your blog subdomain will be taken offline and may be reclaimed by MealBake
All generated recipes, images, and blog content associated with your account may be permanently deleted
Deleted content cannot be recovered after account termination
MealBake will retain certain data as required by law or for legitimate business purposes as described in the Privacy Policy
You may request a copy of your data before deletion by contacting [email protected]

MealBake recommends exporting or backing up any content you wish to keep before deleting your account.

9a. No Liability for Data Loss

MEALBAKE DOES NOT GUARANTEE THE PRESERVATION, AVAILABILITY, OR INTEGRITY OF ANY DATA, CONTENT, RECIPES, IMAGES, OR OTHER MATERIALS STORED OR GENERATED THROUGH THE SERVICE.

Data loss may occur as a result of, but not limited to:

Technical failures, server outages, or infrastructure issues
Accidental or unauthorized deletion
Cyberattacks, hacking, or security breaches
Software bugs or errors
Account suspension or termination
Discontinuation of the Service
Force majeure events as described in Section 16
Any other cause, whether foreseeable or unforeseeable

MEALBAKE SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, CONTENT, RECIPES, IMAGES, BLOG POSTS, OR ANY OTHER MATERIALS, REGARDLESS OF THE CAUSE. THIS INCLUDES BUT IS NOT LIMITED TO DIRECT LOSS, CONSEQUENTIAL LOSS, LOSS OF BUSINESS, LOSS OF REVENUE, OR ANY OTHER DAMAGES ARISING FROM DATA LOSS.

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT BACKUPS OF ALL CONTENT YOU CREATE OR GENERATE THROUGH MEALBAKE. MealBake strongly encourages you to regularly export and back up your recipes, images, and blog content to your own storage. While MealBake will make reasonable efforts to prevent data loss, these efforts do not constitute a guarantee and MealBake assumes no responsibility for any failure to preserve your data.

IF YOU DO NOT MAINTAIN YOUR OWN BACKUPS, YOU ACCEPT ALL RISK OF PERMANENT DATA LOSS. MEALBAKE WILL NOT BE OBLIGATED TO RESTORE ANY LOST DATA UNDER ANY CIRCUMSTANCES.

10. Termination

MealBake reserves the right to suspend or terminate your account at any time, for any reason, including violation of these Terms, without prior notice. Upon termination, your right to use the Service will immediately cease. Unused credits are non-refundable upon termination for cause. MealBake may also immediately deactivate or delete your account and all related data upon termination. MealBake will not be liable to you or any third party for any termination of your access to the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MEALBAKE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

MEALBAKE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING ANY CONTENT GENERATED THROUGH THE SERVICE, INCLUDING ITS ACCURACY, SAFETY, RELIABILITY, OR SUITABILITY FOR ANY PURPOSE. YOU ACKNOWLEDGE THAT ANY RELIANCE ON GENERATED CONTENT IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEALBAKE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

Physical injury, illness, or allergic reactions arising from following generated recipes
Property damage resulting from following cooking instructions
Loss of profits, revenue, data, or business opportunities
Any harm caused to third parties by content published through the Service
Any unpredictable, unforeseeable, or unprecedented harm arising from use of the Service
Any damages arising from reliance on AI-generated content by you or any third party

IN NO EVENT WILL MEALBAKE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO MEALBAKE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF MEALBAKE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY PART OF THE SERVICE OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE IMMEDIATELY.

13. Indemnification

You agree to indemnify, defend, and hold harmless MealBake and its operators, affiliates, officers, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of or access to the Service
Your violation of these Terms of Service
Any content you generate, publish, or distribute through the Service
Any harm caused to any third party by content published on your MealBake blog
Your violation of any third-party rights, including intellectual property, privacy, or food safety obligations
Any claim brought by a third party who followed or relied on content published through your blog

This indemnification obligation applies to the maximum extent permitted by applicable law, including EU member state laws.

14. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

YOU AND MEALBAKE AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT THAT YOU MAY ASSERT INDIVIDUAL CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY.

BY AGREEING TO ARBITRATION, YOU AND MEALBAKE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MAY ONLY BRING CLAIMS AGAINST MEALBAKE IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

Arbitration will be conducted by a neutral arbitrator under the American Arbitration Association's Consumer Arbitration Rules. Any arbitration hearings will be conducted remotely where possible. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Pre-Arbitration: Before initiating arbitration, you agree to first contact MealBake at [email protected] and attempt to resolve the dispute informally. If the dispute is not resolved within 30 days, either party may initiate arbitration.

For EU users: nothing in this section removes your right to rely on mandatory consumer protection provisions of the law of your country of residence.

15. Time Limitation on Claims

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SERVICE OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE. ANY CLAIM NOT FILED WITHIN THIS PERIOD SHALL BE FOREVER BARRED. This limitation applies to the maximum extent permitted by applicable law.

16. Force Majeure

MealBake will not be liable for any failure or delay in performance of its obligations under these Terms arising from circumstances beyond its reasonable control, including but not limited to: civil disturbances, epidemic or pandemic, hostilities, war, terrorist attacks, natural disasters, acts of God, flood, fire, power outages, network failures, or any other event outside MealBake's reasonable control.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts located in the United States.

For EU users: nothing in these Terms removes your right to rely on mandatory provisions of the law of your country of residence. However, any disputes not resolved by mandatory local law shall be subject to binding arbitration under US law.

18. General

These Terms constitute the entire agreement between you and MealBake regarding use of the Service. If any provision of these Terms is found invalid by a court, the remaining provisions will continue in full force. MealBake's failure to enforce any right or provision will not constitute a waiver. You may not assign these Terms without MealBake's prior written consent. MealBake may assign these Terms without restriction. Section titles are for convenience only and have no legal effect.
